Cannabis in Kansas

Neither medical nor recreational cannabis are legal in Kansas. In 2019, the governor signed Claire and Lola’s Law, which went into effect on July 1, 2019 and permits the use of CBD oil containing no more than 5% THC (based on independent testing) for debilitating conditions.

This legislation expanded the state’s existing CBD laws. In 2018, the governor signed a law that allowed for the possession and retail sale of CBD products, but those products must contain 0% THC. In order for medical or adult-use cannabis to be legalized in the state in the future, it must be done through legislation.

Individuals in Kansas may not possess cannabis of any kind. In 2016, a law was passed that reduced the penalty for first-time possession from one year in jail to six months, but the maximum fine for first-time possession stayed at $1,000.

For patients who qualify for low-THC CBD under Claire and Lola’s Law, the law only gives them an affirmative defense to prosecution related to the possession of qualifying CBD products. It does not legalize low-THC CBD.

Medical Cannabis Patient Qualification and Registry

Medical cannabis is not legal in Kansas. Individuals can purchase CBD with 0% THC without being on a patient registry, and qualifying patients with a written recommendation from a physician for a debilitating medical condition may possess CBD oil with up to 5% THC (as verified by lab testing).

The law defines a debilitating medical condition as, “a medically diagnosed chronic disease or medical condition causing a serious impairment of strength or ability to function, including one that produces seizures, for which the patient is under current and active treatment by a physician licensed to practice medicine and surgery in Kansas.”

However, the law doesn’t legalize CBD products with up to 5% THC for qualifying patients. It only provides an affirmative defense against prosecution. Therefore, there are technically no qualifying conditions that give patients legal access to medical cannabis in Kansas.
