Cannabis in Oklahoma
Medical cannabis was approved in Oklahoma in June 2018 and the state began accepting applications for business licenses in August of the same year. By April 2019, the state had issued more than 1,000 dispensary licenses, more than 2,000 grower licenses, and more than 600 processor licenses, making it the quickest state cannabis program to be developed and implemented in the country. Also by April 2019, more than 80,000 patients had registered for the state’s medical marijuana program.

Personal Laws
Oklahoma has not decriminalized marijuana. Possession of any amount of cannabis on a first offense is considered a misdemeanor penalized with up to one year in jail and a maximum fine of $1,000.
Personal Possession
Overall Possession: None
Registered Medical Marijuana Patient Possession: Up to 3 oz. on their person and 8 oz. at their residence
Non-Oklahoma Resident Possession: Visitors to Oklahoma who can prove they’re registered in another medical marijuana state with a regulated program may apply for a temporary 30-day medical marijuana license. The fee is $100.
Personal Growing
Personal growing is allowed in Oklahoma for registered medical cannabis patients.
Registered Medical Patient Growing: Up to 6 mature plants and 6 seedlings
Medical Cannabis Patient Qualification and Registry
Patients must have their applications to become registered medical marijuana patients signed by an Oklahoma board-certified physician. There are no qualifying conditions to apply for the state’s medical marijuana program. Physicians only have to recommend a medical marijuana license for a patient, “according to the accepted standards a reasonable and prudent physician would follow when recommending or approving any medication.”

Business Laws
Vertical integration or “license stacking” is allowed, which means an entity may hold more than one license across the supply chain. Grower, processor, and dispensary license holders are automatically issued a transporter license, but beginning on August 30, 2019, Oklahoma began issuing a stand-alone transporter license as well.
Business entities must prove that at least 75% of the company’s ownership is held by Oklahoma residents. Therefore, new applicants must provide proof of residency showing owners lived in the state for the two years preceding the date of the application or license renewal or for five continuous years during the last 25 years preceding the date of the application or license renewal.

License Timeline
Oklahoma is accepting license applications and has not capped the number of licenses for cultivators, processors, dispensaries, transporters, or testing labs. The Oklahoma Medical Marijuana Authority reviews business applications and renewals within 90 business days of submission.
Testing
Cannabis testing by a licensed lab is required in Oklahoma.
Training
Oklahoma does not require specific training for cannabis license holders.
